EQUIPMENT USE & SAFETY ACKNOWLEDGMENT I agree to use the rented equipment only for its intended purpose and in a manner consistent with the manufacturer’s specifications. I understand that improper use may increase the risk of injury or damage, and I accept full responsibility for using the equipment safely and appropriately. EQUIPMENT RENTAL TERMS AND ACKNOWLEDGEMENT OF RISK & RELEASE I agree to return all rented equipment by the return date specified above in the same condition as received, normal wear excepted. I am responsible for all damage, loss, or theft of equipment up to the full replacement cost. I understand that using outdoor equipment involves serious risks including equipment failure, environmental hazards, user error, bodily injury (including paralysis and death), illness, and property damage. These risks cannot be eliminated and may occur even when equipment functions properly. I voluntarily assume all risks associated with using AMC equipment, including risks from AMC's ordinary negligence. RELEASE AND WAIVER In consideration for renting equipment, I, for myself and my heirs, representatives, and assigns, RELEASE, WAIVE, AND COVENANT NOT TO SUE AMC for any claims, damages, injuries, or death arising from my use of AMC equipment, including those caused by AMC's ordinary negligence. This release covers personal injury, property damage, wrongful death, and all legal costs. INDEMNIFICATION I agree to defend and indemnify (‘indemnify’ meaning protect by reimbursement or payment) AMC with respect to any and all claim/s brought by or on behalf of me, my child or a family member for any injury, damage, death or other loss in any way connected with my/my child's use of AMC equipment, facilities or premises LIMITATIONS This release does NOT apply to AMC's gross negligence, reckless misconduct, or intentional acts. JURISDICTION AND GOVERNING LAW This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any dispute arising under or related to this agreement shall be brought exclusively in the state or federal courts located in Massachusetts, and the parties hereby consent to the jurisdiction of such courts.
